This Agreement waivers any and all liability of Adam and Alicia Padilla, El Paisano Inc., Alicia Lucia Photography, LLC & Padilla Holdings, LLC (hereinafter "Padilla Family Home"), for any use of the swimming pool and/or spa on the property.
A non-parent or guardian cannot legally sign this waiver for other people's children. It must be signed by a parent/legal guardian for children under 18 years of age.
PLEASE READ CAREFULLY AND SIGN BELOW:
By filling out form and signing below, the parent/Guardian and/or child, wish for myself and my child/children to utilize the services, facilities, and swimming pool/spa offered by Padilla Family Home.
I hereby agree that the use of the services, facilities, and swimming pool/spa is voluntary and at my own risk. As a condition of my/our use of such services, facilities, and swimming pool/spa, I, on behalf of myself, my heirs/children expressly agree to forever discharge, waive and release the Padilla Family Home, its residents and insurers, from any and all claims, demands, injuries, damages, actions, or courses of action, for all acts of active and passive negligence on the part of the home on account of physical injury, mental anguish, death and/or property damage arising from any accident, loss, damages or injury suffered by my child(ren) or myself or others connected with or caused by my/our use of the Padilla Family Home, facilities, and swimming pool/spa, including, but not limited to, any injury resulting from mechanical defects or failure of any equipment or devices used in such services, facilities, and swimming pool/spa.
I agree by signing and dating this Agreement confirm that using the swimming pool/spa and other facilities is done so at my/our own risk.
I understand that there is no lifeguard on duty at the swimming pool/spa.
